Je\u017celi dla pracy przewidziano certyfikat autentyczno\u015bci, jest on do\u0142\u0105czany do przesy\u0142ki.<\/li><li>Zakup fizycznego obrazu lub fotografii nie przenosi autorskich praw maj\u0105tkowych, prawa do wykonywania reprodukcji, wprowadzania kopii do obrotu ani komercyjnego wykorzystywania wizerunku pracy.<\/li><li>Jakiekolwiek udzielenie licencji lub przeniesienie praw autorskich wymaga odr\u0119bnej umowy.<\/li><\/ol>\n<h2>10. Subject of sale<\/h2><ol><li>The offer includes in particular unique paintings, ready-made original photographs, open or limited edition prints and works made according to individual arrangements.<\/li><li>Each artwork page should state its main characteristics: title, artist, year, technique, material or paper, dimensions, framing, condition, price, availability and \u2014 for a limited edition \u2014 the copy number and edition size.<\/li><li>Unless the description states otherwise, the sale concerns a physical artwork. Digital files and reproduction rights are not included.<\/li><\/ol>\n<h2>2a. Prices, availability and conclusion of a contract<\/h2><ol><li>Prices are stated in Polish zloty and include taxes due according to the Seller&#8217;s tax status. A price shown beside an artwork is informative until its availability has been confirmed.<\/li><li>Presentation of an artwork on the website does not constitute an offer within the meaning of the Polish Civil Code, but an invitation to make contact. This is particularly relevant to unique works also offered through other channels.<\/li><li>The buyer sends an enquiry using the \u201cAsk about availability\u201d button or by email, identifying the selected artwork.<\/li><li>The Seller confirms by email the availability, precise description, price, delivery cost and time, payment method and links to these Terms and the withdrawal information.<\/li><li>A contract is concluded only when the buyer has unequivocally accepted all the terms provided. Sending an enquiry does not create an obligation to pay.<\/li><li>If the artwork is not available, the Seller will inform the interested person and no contract is concluded.<\/li><\/ol>\n<h2>4. Payment<\/h2><ol><li>Payment is made by bank transfer. The account details and payment deadline are provided by email after the contract has been concluded.<\/li><li>The transfer title should include the artwork name or reference provided by the Seller. Fulfilment begins after the full amount has been credited.<\/li><li>If payment is not credited within the agreed time, the Seller may \u2014 after an additional request for payment \u2014 withdraw from fulfilment in accordance with applicable law.<\/li><\/ol>\n<h2>5. Delivery<\/h2><ol><li>Delivery within Poland is made by insured courier or by agreed personal collection.<\/li><li>The cost and estimated delivery time are provided by email before the contract is concluded. The delivery time depends on the type, dimensions and framing of the artwork and the preparation required for safe transport.<\/li><li>On receipt, the buyer is advised to inspect the parcel and, where damage is visible, take photographs or prepare a report with the carrier. The absence of such a report does not deprive a consumer of the right to complain.<\/li><li>Detailed information is available on the \u201cShipping, payments, returns and complaints\u201d page.<\/li><\/ol>\n<h2>6. Right of withdrawal<\/h2><ol><li>A consumer, and an individual entrepreneur entitled to consumer protection under Polish law, may withdraw from a contract for the sale of a ready-made artwork within 14 days of receiving it, without giving a reason.<\/li><li>The statement may be sent to the Seller&#8217;s postal or email address. The model form provided on the website may be used, but this is not compulsory.<\/li><li>The artwork must be returned no later than 14 days after the statement is made. The buyer bears the direct return cost. Given the nature of an artwork, appropriate protection and insured delivery are recommended.<\/li><li>The Seller refunds the payments received, including the cost of the least expensive ordinary delivery offered for the purchase, no later than 14 days after receiving the withdrawal statement. The Seller may withhold the refund until the artwork or evidence of its return has been received.<\/li><li>The buyer is liable for any diminished value resulting from handling beyond what is necessary to establish the artwork&#8217;s nature, characteristics and functioning.<\/li><\/ol>\n<h2>7. Commissioned and personalised works<\/h2><ol><li>The right of withdrawal does not apply to a non-prefabricated work made to the buyer&#8217;s specifications or intended to meet the buyer&#8217;s individual needs, for example a photograph made in an unusual agreed format, with individual framing, or an artwork created on commission.<\/li><li>This exception does not apply to a ready-made artwork merely because it is unique or signed. Information about exclusion of the right of withdrawal will be clearly provided before a personalised work is ordered.<\/li><li>The scope, price, deadline, advance payment and approval stages for a personalised work may be specified in a separate confirmation or agreement.<\/li><\/ol>\n<h2>8. Complaints<\/h2><ol><li>The Seller is liable to a consumer for conformity of the goods with the contract in accordance with the Polish Consumer Rights Act.<\/li><li>A complaint may be submitted by post or email, describing the issue, purchase date, order number and expected remedy. Photographs may assist assessment but are not a condition for accepting the complaint.<\/li><li>The Seller will respond to a consumer complaint within 14 days of receipt.<\/li><li>The buyer&#8217;s rights, the order of remedies and complaint costs are governed by applicable provisions on conformity of goods with the contract.<\/li><\/ol>\n<h2>9. Authenticity and copyright<\/h2><ol><li>The artwork is by Agnieszka Sawicka unless its page expressly states otherwise. If a certificate of authenticity is provided for the artwork, it is included in the shipment.<\/li><li>Purchase of a physical painting or photograph does not transfer economic copyright, reproduction rights, the right to place copies on the market or the right to exploit the image of the work commercially.<\/li><li>Any licence or transfer of copyright requires a separate agreement.<\/li><\/ol>\n<h2>10. Personal data<\/h2><p>Data is processed for the purposes of handling the order, payment, delivery, accounting, complaints and claims. Details are provided in the <a href=\"\/en_GB\/polityka-prywatnosci\/\">Privacy Policy<\/a>.<\/p>\n<h2>11. Out-of-court dispute resolution<\/h2><p>A consumer may seek assistance from a municipal or district consumer ombudsman, the Polish Trade Inspection or available out-of-court consumer dispute resolution procedures. Information is published by the Polish Office of Competition and Consumer Protection.<\/p>\n<h2>12.
